Q and A

Question

Can my insurer tell anyone I’m positive?

Recently diagnosed and began treatment in the USA. Being that I am covered by medical insurance through my employer, I am fearful that my employer will find out my status due to the high cost of treatment. Can you tell me if my medical records will remain private from my employer?

Answer

Hello,

Thank-you for your question. This is not our area of expertise and it may be worth contacting your insurance company to check this.

My understanding is that your healthcare information should be covered by The health insurance portability and accountability act of 1996 (HIPAA) privacy and security rules. These rules ensure that information relating to the health of an individual is kept confidential. This would prevent your insurance company from disclosing either your HIV status, or the cost of any treatment to your employer.
