{"id":10331,"date":"2010-04-02T11:20:32","date_gmt":"2010-04-02T11:20:32","guid":{"rendered":"http:\/\/i-base.info\/htb\/?p=10331"},"modified":"2013-08-08T12:38:14","modified_gmt":"2013-08-08T12:38:14","slug":"legal-issues-on-hiv-transmission-and-the-law-for-healthcare-workers-draft-guidelines-online-for-comment","status":"publish","type":"post","link":"https:\/\/i-base.info\/htb\/10331","title":{"rendered":"Legal issues on HIV transmission and the law for healthcare workers: draft guidelines online for comment"},"content":{"rendered":"<p><strong>A new joint guideline from BHIVA\u00a0and BASHH on legal aspects of HIV transmission and work of the clinical team is now online for comment.<\/strong><\/p>\n<p>Prosecutions for reckless transmission of HIV have been brought in the UK since 2001 (Scotland) and 2003 (England &amp; Wales).<\/p>\n<p>This has raised complex questions among medical practitioners as to their ethical and legal responsibilities related to HIV transmission, particularly\u00a0around disclosure of information on HIV status.\u00a0Although established generic ethical and professional principles continue to apply, certain features of\u00a0the HIV epidemic have required special consideration.<\/p>\n<p>An underlying principle in the provision of clinical care for people with HIV is the need for a secure and confidential environment in which extremely\u00a0sensitive matters can be frankly and fully discussed. \u00a0The importance of ensuring that full trust is maintained by people with HIV in their clinical\u00a0services in the light of the introduction of the criminal law into the HIV arena is fundamental, not only for the health of people living with HIV but\u00a0also for people who may wish to seek information or testing and thus for the wider public health.<\/p>\n<p>This guidance document sets out these responsibilities and how these relate to the roles and responsibilities of health care professionals when caring for\u00a0individuals infected with HIV.<\/p>\n<p>Comments can be made online and the draft document downloaded from the BHIVA website:<br \/>\n<a href=\"http:\/\/www.bhiva.org\/HIVTransmissionConsultation.aspx\">http:\/\/www.bhiva.org\/HIVTransmissionConsultation.aspx<\/a><\/p>\n\n<p>Deadline for comments is Friday 21 May 2010.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A new joint guideline from BHIVA\u00a0and BASHH on legal aspects of HIV transmission and work of the clinical team is now online for comment.
