Q and A

Question

I already have work permit and working visa in Poland,
I am just waiting for the Medical exam, then I am HIV Positive.

1. Does my employer can cancel my visa once they found out that I am positive?
2. Are they going to deport me to my home country?
3. What are the necessary laboratory test needed for working visa in Poland?

Answer

Hi, how are you doing?

Poland does not have a specific law against anti-discrimination for employment and being HIV positive. HIV status is not directly protected and in cases where it can occur direct evidence is required to support discrimination occurring.

There are lawas preventing work in some sectors e.g., hospitality

You will not be deported. There is no law/regulation about being HIV positive and this will not impact your residency. More information can be found here.

An HIV test can be requested but it is not grounds for deportation.

Further information can be found in answer to this previous question.
